Confessed killer Andrew Gesslein set free, via DA Jim Martin's dirty 'Bait & Switch' charade

Early in the morning on June 29, less than 24 hours after Edna Gesslein told Judge Steinberg under oath that she was $5,000 short on the $15,000 she needed for her husband's bail, Edna Gesslein paid the $15K bail and Michael Randolph's confessed killer Andrew Gesslein walked out of Lehigh County Prison, free (for now).


There are so many excellent questions that deserve to be answered here, LVS-exclusively, so keep checking back, and don't expect any of these questions to be posed or answered (honestly) by our local media or anybody else in Lehigh County.

For example ...

* Did Andrew Gesslein's wife Edna Gesslein commit perjury on June 28 (a la George Zimmerman's wife) when she told Judge Steinberg she was $5,000 short on the $15,000 bail?

* Was Judge Robert L. Steinberg snookered into not raising Andrew Gesslein's bail beyond the ludicrously low recommendation of $15,000 thinking that Edna Gesslein wouldn't be able to raise all of the $15,000? Or was Judge Steinberg in on an incredible Team Martin/Gesslein charade and just playing along?

* Does First Assistant District Attorney and prosecutor Steven Luksa have prior knowledge via his boss DA Jim Martin that "the fix is in" on this case?

* Did an interested benefactor, e.g., the National Rifle Association (NRA) put up the shortfall $5,000 overnight and had they already successfully pressured DA Jim Martin into not filing the appropriate criminal charge in this case, 2nd degree murder, like George Zimmerman got for killing Trayvon Martin?

* If Judge Robert L. Steinberg was snookered by Edna Gesslein, will Steinberg rectify the situation on July 6 at Andrew Gesslein's 10:00am Preliminary Hearing and re-set Gesslein's bail at DA Steven Luksa's suggested price of "one million dollars?"

* When will Al Sharpton's National Action Network take action on the Michael Randolph killing and cover-up in progress?

DA Martin & Judge Steinberg give Michael Randolph's killer an eventual FREE PASS










LVS attended the 6/28 bail hearing for Michael Randolph's confessed killer, Andrew Gesslein (in handcuffs), see Criminal Docket and Miscellaneous Docket.

Not surprisingly, DA Jim Martin's press agent The Morning Call "newspaper" in its coverage is skillfully diverting the public's attention away from the relevant and damaging issues by sensationalizing a predictable Andrew Gesslein lie that was revealed in court today [read "newspaper" account].

Much more revealing are the inconvenient facts that were exposed in court today that The Morning Call "newspaper" is purposefully not covering.

For example ...

* Andrew Gesslein's employer, former cop Pat Badolato/Eye In The Sky is poised to welcome licensed NRA firearms instructor and confessed killer Andrew Gesslein back to his old security/bouncer job with open arms as soon as he's bailed out of Lehigh County Prison. Wrongful death litigators, take note.

* Andrew Gesslein's work resume includes the job title "Fugitive Recovery Specialist" (a.k.a. "bounty hunter"), a job that's way more rough & tumble than security/bouncer and one that took Andrew Gesslein all over the country and educated him on the many ways that bail-jumping criminals can elude re-capture.

* Since 2003, Andrew Gesslein has been on disability for a "bad back" Q. How could bounty hunter Andrew Gesslein specialize in recovering badass fugitives w/ a bad back? Somebody should ask the disability payments office, maybe they know.

* A pal named "Beasley" is currently holding Andrew Gesslein's dozen-plus guns for him. Beasley "might sell the guns" for Andy. Or maybe Beasley won't. Nobody knows for sure. The Express-Times claim about Andrew Gesslein's guns being sold to pay his bail is head scratching fiction that'll probably disappear from their article shortly [LVS emails corrections to the ET's Colin McEvoy regularly which he and his editors execute immediately but they never say thank you to us].

* Lehigh County Court of Common Pleas Judge Robert L. Steinberg tipped his outcome hand two seconds into the hearing by telling everyone that because DA Jim Martin hadn't charged Andrew Gesslein with a possible death sentence offense or a possible life in prison sentence crime like 2nd degree murder [Note: like George Zimmerman got for killing Trayvon Martin], there are no legal grounds to deny Andrew Gesslein bail [Note: Voluntary Manslaughter, the comparatively sweetheart charge Andrew Gesslein is facing (for now) was originally listed as a "Non-Bailable Offense" on Andrew Gesslein's Criminal Docket. Voluntary Manslaughter is a bailable offense].

But anyways, let the courtroom play acting charade begin.

* First to testify was Pretrial Officer Ashley Stumpp from Lehigh County Pretrial Services. Regular readers of LVS will recall that these are the folks who somehow allowed my daughter Sheena's killer Robert LaBarre to leave the country and enjoy a 10-day vacation in Belize Central America while he was out on $0.00 bail for killing my daughter Sheena. When asked by First Assistant DA Steven Luksa if she knew if Andrew Gesslein had a passport or not, Ashley Stumpp was stumped and testified that she "didn't know" which means that she obviously hadn't asked Andrew Gesslein this highly relevant question regarding flight risk and determining flight risk is probably Pretrial Services' most important function.

* Ashley Stumpp was further stumped by the question, "Do you know how many guns Andrew Gesslein owns?" Ashley Stumpp didn't know the answer, which turned out to be "between 12 and 14 guns," even though determining a defendant's danger to the community is probably Pretrial Services' 2nd most important function.

On top of all this, it was revealed today in court that Andrew Gesslein had (for years) misled his wife Edna (and who knows who else) into believing that he had been a police officer in Bergen County, New Jersey. Edna testified today that her husband had paperwork that verified it but that she had forgotten it at home. But Andrew Gesslein's arresting officer and an Allentown Police Detective both testified today that they contacted Bergen County NJ police authorities, and they had no record of an Andrew Gesslein ever being a police officer in New Jersey.

Incredibly, Ashley Stumpp (shamelessly stumping for confessed killer Andrew Gesslein) then recommended to Judge Steinberg that Andrew Gesslein be granted bail ... "10% bail" in the amount of only $150,000, meaning that all Andrew Gesslein would need to put up would be $15,000 of his own money (10% of $150k) to get out of jail.

To date, supporters of Andrew Gesslein have raised $10,000 ... so all they need to raise is $5,000 more and Andrew Gesslein goes free to await a trial in a year or two, or more likely, a 'bargain' plea deal from DA Jim Martin a coupla years down the road after the case is nice and ice cold, and involving a criminal charge even lower and more insulting than voluntary manslaughter.

Judge Steinberg asked First Assistant DA Steven Luksa if he opposed bail for Andrew Gesslein and DA Luksa responded that he "did not oppose it."

* Judge Steinberg then asked DA Luksa what bail amount he would recommend for Andrew Gesslein and DA Luksa inexplicably and curiously blurted out, "a million dollars," when he could have more realistically requested $250,000 or $500,000.

Judge Steinberg had the authority, and the obligation, in our opinion, to set a bail amount for Andrew Gesslein high enough to keep him incarcerated until trial, and/or high enough to ensure his not being a flight risk or a danger to the community. After all, confessed killer Andrew Gesslein is looking at a sentence of 10 to 20 years in the State Penitentiary if convicted of Voluntary Manslaughter, and at sentencing, he would get credit for the mere year or two of time already served in Lehigh County Prison.

* By agreeing with Ashley Stumpp's alarmingly incompetent and low bail recommendation of $15,000, knowing that Team Gesslein is only $5,000 away from having their $15,000, Judge Robert L. Steinberg and DA Jim Martin gave Andrew Gesslein an eventual free pass out of jail at an insulting bargain price.

It's only a matter of time, and not much money, until confessed killer Andrew Gesslein is set free.

Curiously (as of the time of this blog post), there's no mention of this pre-preliminary hearing bail hearing in the Andrew Gesslein Criminal Docket that the public has been following via this blog and the Justice for Michael Randolph Facebook Page since June 7.

Instead, on June 15, Team Martin/Gesslein quietly created this Andrew Gesslein Miscellaneous Docket where they've skillfully hidden Andrew Gesslein's secret June 28 bail hearing in plain sight (but only if you know where to look) to cover their crony crooked asses.

LVS is pleased to announce that licensed NRA firearms instructor and confessed killer Andrew Gesslein's June 28 VIP bail hearing isn't a secret anymore and we hope to see you all there.

Naturally, there's been no coverage of Andrew Gesslein's formerly secret bail hearing by DA Jim Martin's local press agent, The Morning Call "newspaper."

Q. How can Andrew Gesslein have another bail hearing? The first one was on 6/7/12 and bail was denied, the reason being that Voluntary Manslaughter is a "non-bailable offense" as is noted in the criminal docket (see page 2). If the criminal charges haven't changed (yet), how can they now be a bailable offense? Is DA Jim Martin caving to pressure from the NRA?

Q. The Andrew Gesslein blind spot Miscellaneous Docket that was created on June 15, 2012 states that it's for "Magisterial District Judge Matters." Then how come the secret bail hearing's presiding Judge Robert L. Steinberg is a judge of the (higher court) Lehigh County Court of Common Pleas?

Eyewitness to Michael Randolph killing says DA Jim Martin's local media accounts are false

Thomas Hawkins lives in Idaho and works for the U.S. Forest Service. When we spoke by cell phone on Tuesday June 12 at 6:07 pm EST, T-Tom Hawkins was fighting a forest fire in 98 degree temperature in Arizona.

A former longtime Allentonian and a 2008 graduate of Allentown's William Allen High School, Tom Hawkins and his brother were with their friend Michael Randolph the night Randolph was shot three times and killed by licensed National Rifle Association firearms instructor and security guard Andrew Gesslein [Criminal Docket] at Allentown's North End Republican Club on April 29, 2012.

After 40 days of online, on-street, and political pressure from Allentown Mayor Ed Pawlowski, DA Jim Martin finally charged Andrew Gesslein with voluntary manslaughter on June 7, read LVS account, then read the DA Jim Martin-friendly account by WFMZ-TV 69 "News."


Turns out Michael Randolph's white killer Andrew Gesslein is a law enforcement insider who works for ex-cop Pat Badolato/Eye In The Sky, inconvenient facts that were purposefully concealed by our local media for 28 days but were reported on exposé exclusively here at LVS over a month ago. On June 13, LVS learned from an attorney colleague of DA Jim Martin that Andrew Gesslein is also familiar to our local law enforcement community in his capacity as a bail bondsman "bounty hunter." But again, no mention of this in our local media.

Incredibly, in DA Jim Martin's local media accounts of Andrew Gesslein's arrest, NO PHOTOS of caucasian criminal defendant and licensed NRA firearms instructor/confessed killer/bounty hunter Andrew Gesslein were published or broadcast-- no perp walk, no mug shot, no nuthin', although DA Jim Martin's local media peppered and slanted their coverage w/ numerous photos of the deceased victim Michael Randolph. To date [6/27/12], no photos of Andrew Gesslein have appeared anywhere in DA Jim Martin's local media.

Tom Hawkins and his brother cooperated fully with local law enforcement investigators. Allentown Police Detectives interviewed both Hawkins brothers and both made statements on the record soon after Michael Randolph's killing.


Tom Hawkins and his brother were standing next to Michael Randolph at the North End Republican Club before and after Andrew Gesslein started shooting on April 29. Tom Hawkins heard 4 shots. Andrew Gesslein told authorities he fired only twice. DA Jim Martin's local media accounts have admitted to 3 shots (for now).

According to DA Jim Martin's local media accounts ...


The Express-Times > "Gesslein told police Randolph made repeated threats to kill him, saying: "I'll kill you," "We should (expletive) you up" and "If you don't let me in, we're going to fight." Note: There's no mention of "2 witnesses" corroborating Andrew Gesslein's story about 'threats to kill' in The Express-Times's account as was declared in The Morning Call's account.

According to T-Tom Hawkins ... who was there ... none of this happened.

Neither Michael Randolph nor his friends verbalized anything even remotely resembling threats to kill anyone, according to Hawkins.

"Is the 'threats to kill' story total bullshit?" I asked Tom Hawkins. "Yes," Tom told me.



Note: So basically, DA Jim Martin is taking confessed killer Andrew Gesslein's word for this, that Michael Randolph 'reached for his waist area,' as well as the 'threats to kill' story-- and this is the same killer who claimed to have fired 2 shots but in fact had fired at least 3. Not very credible, this Andrew Gesslein, although DA Jim Martin sure does like to quote him in his local media accounts.

Now we're getting closer to the truth.


Here's Tom Hawkins's account of what actually happened that night, as told to me over the phone on June 12 ...

Michael Randolph and the Hawkins brothers were anticipating entrance to the North End Republican Club at the club's back entrance. When the door swung open, the three men started to enter the club; they did not "force their way in," as is being reported in DA Jim Martin's local media accounts. When security guard/doorman Andrew Gesslein spotted Michael Randolph, he had a noticeable bad reaction (more on this later) and he slammed the door so quickly that it hit, and caught, Michael Randolph. Randolph shoved Gesslein. Once. Gesslein shoved Randolph back, stepped back, drew his weapon, and shot Michael Randolph 3 times, killing him.

Why did Andrew Gesslein have a noticeable bad reaction to seeing Michael Randolph that night?

As North End Republican Club President Robert E. Smith told LVS, and The Morning Call, Andrew Gesslein and Michael Randolph had had 'words' during a previous run-in. Gesslein knew aspiring rapper Randolph who was no stranger to the club; Randolph had frequented the club in the past, including the previous night with the Hawkins brothers, and Randolph had performed at the club recently.

Bob Smith told LVS he was perplexed by this paragraph in The Morning Call "newspaper" coverage of security guard Andrew Gesslein's arrest ...

"Club President Robert E. Smith Jr. has said Gesslein had a run-in with Randolph weeks before the killing, but Martin said investigators found no evidence to prove that claim."

Note: DA Jim Martin should try asking Andrew "Gospel" Gesslein about the claim ... because ... according to Bob Smith, it was Andrew Gesslein himself who told Bob Smith about his prior run-in w/ Michael Randolph.

When I theorized to Bob Smith that DA Jim Martin likely wanted to cover up the prior run-in because it could explain Gesslein's being inexplicably armed that night ... and might also indicate possible pre-meditation ... Bob Smith didn't seem perplexed anymore.

Bob Smith also told LVS that "everybody entering the North End Republican Club is frisked."And because everybody who goes there regularly (including Michael Randolph) knows this, "nobody ever brings a gun in," Smith told LVS.

In a phone conversation w/ LVS on June 12, North End Republican Club President Bob Smith reiterated that he stands by his statement that there was a prior run-in between killer Andrew Gesslein and victim Michael Randolph, as was reported to Bob Smith by Andrew Gesslein himself.

After previewing and approving the content of this blog post prior to publication, eyewitness Tom Hawkins stands by his statements made to LVS too, which are the same statements he made on the record to the Allentown Police Department soon after Michael Randolph's killing.


The Big Lie that's being perpetrated on the public by DA Jim Martin and his local media is that Michael Randolph and his friends "threatened to kill" Andrew Gesslein, then "forced their way in" through the club's "back door," where Michael Randolph then "reached for his waist area," i.e., "reached for a gun."

As this blog post clearly demonstrates, the "threats to kill" is total bullshit. So is the "forcing their way in." No witnesses (except confessed killer Andrew Gesslein) saw Michael Randolph "reach for his waist area" which is what every law enforcement person who wrongly shoots somebody claims afterwards. Michael Randolph was unarmed. And the "back door" at the North End Republican Club is actually the main entrance to its after-hours club that everyone uses.

Subtract all the bullshit from the equation and ...

The just and appropriate criminal charge in this case appears to be 2nd degree murder, like George Zimmerman got for killing Trayvon Martin.
