An Appeal For Justice

Readers, on Tuesday afternoon, May 19, 2009, Wind Gap, Northampton County District "Justice" Adrianne L. Masut found me guilty of summary harassment and ordered me to pay one hundred dollars ($100.00).

It was an, um, surprising verdict, since the Complaining Witness, Bernie O'Hare, presented no evidence and no documentation to prove his claim that "Bill Villa posted over 500 comments" at his blog on 9/29/08.

And don't forget: the burden of proof beyond a reasonable doubt was on O'Hare.

So we were expecting to see account records from Internet service providers, and expert testimony on IP numbers, and hard copy matchings (a-ha!) of those 500 comments w/ "Bill Villa's IP number!"

Nah.

Instead, O'Hare just breezily told the Magistrate that he has a "sitemeter" on his blog and that it was his "opinion" that "Bill Villa posted those comments" and that he was "positive Bill Villa did it, Your Honor."

And this was good enough for DJ Adrianne Masut who pronounced me guilty of summary harassment based solely on O'Hare's word.

Yup.

Curiously, DJ Masut skirted completely around (and didn't rule on) the "repeated invitations to fist fight" and "break your jaw" stuff in O'Hare's harassment complaint (i.e., the "flashy" items O'Hare used to hoodwink easily duped NorCo DA John Morganelli into "OK-ing" O'Hare's complaint forward and into Magisterial Court), likely because my attorney had earlier revealed those falsely sworn affidavit claims to be flat-out lies on O'Hare's part. But O'Hare's tarnished word was "gold" on the 500 comments ... as DJ Masut saw it.

We filed an appeal immediately.

Stay tuned for Round 2 in front of a Northampton County Court of Common Pleas Judge in 6 months or so ...

FYI, O'Hare's stated witnesses: AJ Cordi, attorney (for now) Dull Dave Najarian, and Mike Molovinsky were all pusillanimous no-shows.

Anon 3:25am ... master debater? No, it wasn't like that at all, unless you wanna add a "wink wink" after master. O'Hare seemed totally unprepared and was master of nothing. His initial "strategy" was to side-step everything in his complaint against me and muddy the waters w/ all sorts of irrelevant grade-school "he said, she said" nonsense, which the magistrate wouldn't allow. When matters finally turned to the deceit in O'Hare's complaint, my lawyer (figuratively) broke O'Hare jaw in nine different places-- item by item.

It was embarrassing. It was also hard to picture O'Hare ever having been a lawyer himself-- he didn't know the proper procedures, he spoke out of turn, his hands were shaking, and at one point (when my lawyer was proving beyond all reasonable doubt that O'Hare provokes people and then cries "mommy" when they defend themselves), O'Hare actually had the Jesus-complex nerve to ask the Magistrate ...

"Are you going to allow him to speak to me that way?"

The Magistrate seemed to be having some difficulty concealing her disdain for O'Hare.

But the bottom line is that O'Hare proved nothing in his private criminal complaint against me.

Zip.

And proving that stuff, beyond a reasonable doubt, is the legal requirement for finding a defendant guilty.

As we will demonstrate on appeal, neither the Complaining Witness (O'Hare) nor the District Magistrate (Masut) satisfied those legal requirements.

Oopsie.

Recently, former Morning Call "courthouse beat" reporter Debbie Garlicki became a full-time public relations operative in DA Jim Martin's office.

Some would say Debbie's new job isn't all that different from her old job but I digress.

My question is: was this a new position created for Ms. Garlicki, and, possibly, as a political reward for Debbie's many years of meritorious P.R. service to DA Martin while at The Morning Call? Or has this full-time P.R. position been a budget item in DA Jim Martin's office previously?

I figured you fine folks, as Lehigh County Commissioners, would be best qualified to address this excellent question that deserves to be answered.

sad to know even DJ's politicise from the bench in direct violation of the law. you've had to fight for evry scrap of justice (criminal and civil) you've gotten in Lehigh County so far and things will be no diferent in NorCo it appears. Getting on with your life will obviously include kicking their asses on appeal in NorCo. All the best to you.

...in a way, this kind of worked out for you. now you have o'hare (and morganelli) right where you want them. they had to be crazy to underestimate you in light of what you've accomplished in lehigh county on both the criminal and civil sides, even though all the powers that be were lined up against you. and these kinds of overwhelming odds seem to please you.

My Take...

We are all in very big trouble as a civilized society when someone can trump up phony charges against an "enemy" and get a district attorney friend to rubber stamp them, and then arrange for a judge to convict that person based purely on the phony charge filer's "say so" and w/ no proof whatsoever. There are constitutional rights being violated here in addition to jurisprudence 101 principles that a person is presumed innocent until proven guilty ... beyond a reasonable doubt. And this last part, "beyond a reasonable doubt," appears to have been deemed not applicable in Wind Gap Pennsylvania on Tuesday afternoon, May 19, 2009. An appeal for justice here is entirely appropriate and I commend Mr. Villa for pursuing it, especially considering all the prior injustice he has plowed through in the last 3 years.

Maybe there's a good reason (?) for this but The Morning Call "newspaper" obviously doesn't know (or care) what it is ...

so how bout asking the crooked and incompetent and falling down drunk w/ abuse of power and process DA in both cases Jim Martin about this?

LVS and you Villas are obviously the only investigative reporters in a 100-mile radius who aren't scared shitless of Jumbo (hiccup) Jimbo (burp).

Bill, in O'Hare's sworn affidavit against you (which you publishd word for word and "in O'Hare's face" at O'Hare's own troll blog), O'Hare swore, under oath, that you:

"threatened me (O'Hare) with repeated invitation to fistfight"

and also that you communicated to O'Hare:

"I'd like to break your jaw in seven different places"

Bill, I'd be very interested in knowing how these very serious and very public (thanks to O'Hare's harpings) allegations against you were handled during the May 19th hearing. These alleged statements of yours (according to O'Hare) were the main basis for DA John Morganelli approving O'Hare's criminal complaint against you.

If you don't want to address my (excellent?) questions, I will understand.

#1. I never communicated this statement to O'Hare:

"I'd like to break your jaw in seven different places."

What I actually posted at O'Hare's "Troll Parade" blog, and you can look it up, on September 8, 2008, at 2:17PM, in response to vile provocations O'Hare had e-mailed my wife, Angie (Mrs. Dottie), was this:

"I believe most husbands with less self-control than I would have broken your jaw in nine places over those remarks."

O'Hare then outright lied to his buddy DA John Morganelli, and on a sworn affidavit (oopsie), by reporting, falsely, and knowingly, that I had said this:

"I'd like to break your jaw in seven different places."

Readers, O'Hare swears he doesn't see the Big Difference between these two statements. No matter. District Justice Adrianne L. Masut perceived the Big Difference in court on May 19th.

Readers, in court on May 19, O'Hare sheepishly admitted to Magistrate Masut that there was just one (1) invitation to a fist fight (not "repeated" invitations) and O'Hare actually read the same "invitation" to the Magistrate that we were gonna read in my defense (oopsie). From the "Troll Parade" blog, September 27, 2008, 3:51PM:

((Me)) How about this: let's "settle" all this via fist fight. Like men. And this isn't a threat; it's an invitation. Your thoughts?

Rightly, Magistrate Masut again discerned that O'Hare was lying about "repeated invitations to fist fight."

So readers, don't believe Mike Molovinsky when he writes about hiring "security" for his upcoming "KvetchFest" to guard against "jaw-breaker," Bill Villa. Mike's just fanning the flames (and blowing smoke) around another of O'Hare's Many Big Lies-- which seems to be Mike's only reason for being alive and still on this good green Earth (not a threat).

Bill, I'm sure you'll be vindicated on appeal. But will we ever know who (if anyone) "pulled the string" for Mr. Anti-Pay To Play O'Hare in Wind Gap on 5/19 (surely, D.J. Masut is familiar w/ the conviction requirement of proof beyond a reasonable doubt). It's another excellent question that deserves to be answered. All the best to you.

Readers, here's O'Hare's Account of our 5/19 hearing.

Interestingly, O'Hare provides no proof of my having posted those 500 comments at this blog post on the topic.

And O'Hare's "proof" isn't in the hearing's transcripts either, which I own.

In his post, O'Hare corroborates my contention that Magistrate Adrianne L. Masut found me guilty based solely on O'Hare's word. Readers ... this is not how our courts are supposed to operate.

And this story is far from being over, stay tuned.

Like Allentown City Council President Michael D'Amore who also contacted the newspaper on my behalf, you believed there was merit to my "excellent questions that deserved to be answered" regarding DA Jim Martin and his office's "special handling" of several DUI homicide cases.

As those who were involved in interceding on my behalf know, I caught Mr. Kranzley lying to you all about his reasons for denying me the "Welcome Mat" meeting his Editorial Board extends to "anyone [else] who wants to be heard." And Mr. Kranzley then continued to stubbornly deny me the opportunity to be heard a total of 227 times.

I hope you all will join me in applauding The Tribune Company's wise decision to fire Glenn Kranzley.

BUT... (in this case what follows the 'BUT' is NOT Bu11$hit), the Villas will prevail.

There is no way a man can be prven guilty based soley on such unfounded accusations. Well, obviously there is a way, but it cannot be upheld for long unless the accused are just willing to lay down and die.

Keep up the good work and keep fighting the good fight. Justice will prevail in the end.

O'Hare flat-out lied to DA Morganelli about my alleged "threats of violence." This is how O'Hare got Morganelli to approve his criminal complaint and get it into magisterial court. O'Hare had an in-person meeting w/ Morganelli on it (this is in the 5/19 trial transcripts which I own exclusively). Q. How many other private citizens filing a summary harassment complaint get to meet w/ the DA on it? A. None.

As detailed earlier, it took my lawyer about 2 minutes to totally de-bunk for Magistrate Masut O'Hare's SWORN AFFIDAVIT claims regarding my "threats of violence."

O'Hare duped an alarmingly pliable DA John Morganelli and by the time our appeal is completed I'll make sure every voter in Northampton County knows this.
