"The Homicide while DUI was "dropped" because the hospital lost or never had the proper paperwork to maintain a chain of custody on the drivers blood. Once that charge was gone there was no plea bargain, Squires simply pled guilty to the balance of the charges. I told the reporter that yesterday when we spoke but she omitted it from the article. I obviously wish the whole truth had been printed. Thanks LVHC"

The key question here (that The Morning Call will never ask, of course), is why would Lehigh County DA Jim Martin bargain away the appropriate charge in this case, Vehicular Homicide While Driving Under The Influence, for a defendant who got a 2nd DUI after killing someone? It's not like this guy earned himself a break with that 2nd DUI, right? Once again, DA Jim Martin demonstrates that he is, truly, the Best Friend Of Homicidal Drunk Drivers Everywhere. It's a crime that no one is running against him for reelection in November 2007.

Since when does DA Jim Martin consider the victim's family's wishes? Let me get this straight ... Martin went EZ on a drunk driver who killed someone because the victim's family "didn't want to see the kid in state prison?" I'm not buying this. What about DUI death victim families who wanted a harsher charge filed? Martin totally ignores them. And am I reading this correctly ... it seems like the victim's family who agreed to the lesser charge wasn't told about the defendant's 2nd DUI until AFTER they agreed to the lesser charge. Wow. Looks like Big Jim is fixing this case in plain sight. And watch ... nobody's gonna stop him.

Mr. Mohney, thank you for the clarification on the chain of custody regarding the blood. This is incredible. As I see it, at least two things need to be investigated here. One, who was Morning Call reporter Debbie Garlicki protecting with her stunning omission of this part of your story? And two, was it really LVHC who mishandled the blood evidence (they do, after all, handle DUI death cases all too frequently; i.e., they do know the proper protocols) or did DA Jim Martin possibly have a hand in this "lost" evidence. I've heard rumors that Mr. Martin is long-time friends with a member of the defendant's family. Do you think Mr. Martin is trying to fix the case? His handling of many DUI death cases has been questionable ...

Excellent Question, Chris.

A. It's because DA (for now) Jim Martin knows that LVH is effectively gagged and muzzled from defending itself by HIPPA Patient Privacy Constraints.

And don't forget, what Chris Mohney was told by the DA's office about the LVH blood evidence "screw-up" (wink wink) conveniently never made the "newspaper."

DA Martin can claim that Chris Mohney must have been hearing voices, when in reality, the hissing viper voice was that of Deputy DA Renee Smith.

I believe Lehigh County voters are starting to see how unopposed DA Jim Martin plays all the crooked angles ...
