Lehigh County District Attorney Jim Martin goes easy on yet another drunk driver/killer

Readers, LVS can barely keep up (scroll down, see previous posts) w/ the back-up of back-ordered DUI homicide cases that snoozy and boozy DA Jim Martin is cleaning out from the bottom of his desk (because it's an election year) while everyone is on vacation and won't notice, Martin hopes.

This "latest" DUI from 2010 involves a death, and serious injury, and is again skillfully spun and downplayed online by DA Jim Martin Morning Call "newspaper" "reporter" and adorable lapdog Kevin Amerman.

Here are The Inconvenient Facts in a nutshell ...

* By law, Pennsylvania judges like Robert L. Steinberg must sentence drunk drivers who kill people to a state mandatory minimum prison sentence of 3 years in a Pennsylvania State Penitentiary for the charge of Vehicular Homicide While DUI.

* The homicidal drunk driver in this case, Joseph M. Hammer, was sentenced to serve around 18+ months in Lehigh County Jail.

Why?

* Because "no nonsense" (?) DA Jim Martin generously (hiccup) plea-bargained away the major charge of Vehicular Homicide While DUI ... and most of the other charges.

Why?

* Because, as The Morning Call helpfully (and skillfully) tells us, the wishes of the victim's family were that they did not want to see their son's killer go to jail.

* This is curiously inconsistent w/ my family's experience. And our wishes. We wanted an appropriately stiff state prison sentence for our daughter Sheena's DUI killer, Robert LaBarre. One that was commensurate with the crime Robert LaBarre committed against Sheena Villa. But DA Jim Martin told me that he did not represent Sheena's family, he represented Lehigh County, and that our wishes were not a factor in the criminal charges he chose to file, and to not file.

Bill you are so right. Whenever a crime victim's family wants to go easy on their perpetrator, Jim Martin is only too happy to accommodate them because it means LESS WORK FOR HIM. And its definitely a one-way street in that Martin ignores crime victim families who want a measure of justice that REQUIRES WORK FROM THE DA. In both scenarios, Mr. Martin is disgracing his duty to "represent Lehigh County." Keep the heat on this bastard Jim Martin, I know for an inconvenient fact that there are lots of people reading this blog every day and rooting for you at City Hall and the Lehigh County Courthouse.

I feel very bad for what you have gone through. I cou,d not imagine loosing any of my children especially to a drunk driver. However, you do have to admit every case is unique. I don't know all the political jargon that you speak of and don't know all the facts in your daughters case, but do you really think there should be one blanket law. Now excuses. No possibility that some of these DUI cases are just a horrible accident. I can tell you your wrong in the case of Joe Hammer. Joe is not the "blackout drunk " you describe. Joe is not the habitual drinker theta drives drunk repeatedly. Joe was a young kid like other DUI drivers that thought he was fine. The victims family did ask for la light sentance, this I know for a fact . In your daughters case the DA didn't take your feelings into account, but yet you wanted him to, right? And now you chastise for taking the victims families feeling into account. Joe Hammer is a good kid. Comes from a great family and I think what you are doing is great (being a watchdog) but. There can not be just a blanket conviction in every case. You are wrong for bad mouthing every single offender. Should they be punished? Absolutely!. But let's look at them case by case. Sometimes bad thins do happen to good people. Including you and Joe.

FYI, there's a (documented here at LVS) pattern to DA Jim Martin's crookedness and incompetence when it comes to prosecuting drunk drivers who kill people.

Get familiar w/ it and don't bother commenting here again until you know the facts.

Wow. It took DA Jim Martin an inexplicable and inexcusable 5 months to charge Joe Hammer.

But anyways, "thanks" for putting in the considerable amount of time it must have taken to find this previously concealed article, "anonymous" (wink wink), although we suspect that someone at The Morning Call likely tipped you off regarding where to find where The Morning Call had hidden it-- because it did not come up via search of the "newspaper" archives as of Thursday. In any case, LVS stands corrected on this single point (good for you) and unchallenged and un-refuted on the other 3.1 million dirty and verifiably factual DA Jim Martin exposures you'll find here at LVS.

The Morning Call routinely reshuffles its archives and hides (and scrubs) articles like a stacked and marked deck (or house) of cards.

See proof of "reporter" Manny Gamiz's retroactively deleted "newspaper" article paragraph in the update section of LVS's terrific post from March 15, 2009.

And in a shiatsu sex scandal involving Morning Callers Debbie Garlicki and Paul Carpenter, the "newspaper" scrubbed an entire article from its archives, see LVS's eye-opening post from January 25, 2011.

I wouldn't "stand corrected" when the other side so obviously cheats and lies but that's just me.

Q. What's it to them (David Najarian, Chris Casey, Bill White, Molovinski, the Donovans, Jeff Pooley) that Bill Villa has legitimate complaints re: DA Jim Martin and The Morning Call "newspaper?" Why are they so compulsively interested in Bill's efforts in exposing some things around here? Obviously, Bill has the FACTS and he can communicate them w/ frightening precision and the same goes for Mrs. Villa. Are their fellow bloggers simply JEALOUS of this blog's obvious journalistic and literary superiority? Is there some quid pro quo (pay to play) happening between Martin's office, the "newspaper" and these saboteur bloggers? Is Martin really steamed that Bill out-foxed him so embarrassingly w/ the LeBarre prosecution? Is it ALL of the above? SOMETHING'S got to explain why all these hate bloggers (Chris Casey, Bill White, "anonymous") spend more time HERE than at their own blogs.

Bill I could definitely see Jim Martin paying Morning Call "insider" bloggers like Chris Casey to undermine and sabotage you. Or rather it would be the Committee to Reelect Jim Martin that would be paying "Team Casey" (i.e., Lee Butz, Mal Gross, Pat Reilly, Bill and Phyllis Grube from 3015 Barrington Lane in Allentown, host committee person (and judicial candidate/"oopsie") A. Renee Smith), etc. etc. follow the money indeed!

to what purpose gary? better you should ask the council of churches how many unemployed new residents they staked to move in money. better you should ask the county welfare workers how many calls they received from first day residents who already somehow new the menu of available entitlements. better you should ask the census bureau how uncommon it is for an entire city to go from middle class to poverty within 10 years. ask the school district how many more students qualified for a free lunch. we have some very dynamic advocates for the poor, who did their job perhaps too well.

at this point in time, the only challenge i accept is to attempt to modify the park department priorities, to preserve the WPA structures.
